Terms and Conditions

1. Definitions

• "Ohh-Snaps," "we," "our," or "us" refers to the business that owns and operates the Platform.
• "Customer" refers to a registered user who creates or manages an event.
• "Guest" refers to anyone who accesses an event hub using a QR code.
• "User" refers to both Customers and Guests collectively.

2. Platform Access

For Customers (Event Hosts):

• You must create an account to access the dashboard and manage events.
• You are responsible for maintaining the confidentiality of your login credentials.
• You may not impersonate another person or use false information when creating your account.

For Guests:

• No registration is required. Guests access events by scanning a QR code.
• Guest access is limited to the event's duration and content availability period.

3. Event Content and Uploads

• Guests may upload photos, videos (up to 30 seconds), and voice messages (up to 30 seconds via the Phone Booth feature).
• Content is stored for 90 days by default after the event ends. Event hosts may extend storage by purchasing additional time.
• Content uploaded by Guests remains their property, but by uploading, Guests grant Ohh-Snaps and the event host a limited, non-exclusive, royalty-free license to use, display, and distribute that content within the context of the event.

4. Raffles, Trivia, Scavenger Hunts, and Games

• Optional games such as raffles, trivia, and scavenger hunts are built into the Platform or linked experiences and can be enabled by the Customer.
• These features are intended for entertainment only. No monetary or prize-based gambling is permitted through the Platform.
• Ohh-Snaps is not liable for the outcome or administration of any raffle, trivia, hunt, or prize hosted by Customers.
• SMS for hunts and similar games: If you choose to participate using a mobile number, you agree that we (and our messaging provider) may send you text messages for that activity, including a confirmation step (e.g. replying YES) and gameplay messages such as clue links. Message and data rates may apply. You can opt out of further texts for that flow using instructions in the messages (e.g. STOP). You must use a number you control and must not sign up others without permission.

5. User Conduct

• Users must not upload or share content that is offensive, illegal, harmful, or violates any intellectual property rights.
• Users must not attempt to access accounts or content they are not authorized to use.
• Users must not reverse-engineer, disrupt, or otherwise interfere with the functionality of the Platform.
• Ohh-Snaps reserves the right to remove content or suspend access for any user who violates these terms.

6. Fees and Payments

• Ohh-Snaps operates on a per-event pricing model.
• Fees are displayed at the time of purchase and are non-refundable unless otherwise stated in writing.
• Add-ons and extensions (e.g., extended storage, games) may incur additional charges.

7. Disclaimer and Limitation of Liability

• Ohh-Snaps provides the Platform "as is" without any warranties.
• We are not responsible for technical failures, data loss, or content moderation unless explicitly stated.
• Customers are solely responsible for managing their events and complying with any legal or regulatory requirements.

8. Privacy and Data Handling

• We do not require personal data from Guests for basic hub access. If you choose optional features, you may submit data such as name or email (e.g. raffles) or a mobile number (e.g. SMS-based games such as scavenger hunts), as described in our Privacy Policy.
• Customer information and event data are handled in accordance with our Privacy Policy.
• SMS delivery uses a messaging service provider acting on our behalf; see the Privacy Policy for details.

9. Termination

We may suspend or terminate access to the Platform at any time, with or without notice, for violations of these Terms or misuse of the service.

10. Modifications

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting. Continued use of the Platform after changes are posted constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Users are responsible for complying with local laws based on their location.
